## OVERVIEW
Welcome to MooMoo K-pop. The terms “we”, “us”, and “our” refer to MooMoo K-pop. MooMoo K-pop operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you with a curated shopping experience (the “Services”).
These Terms of Service (“Terms”) describe your rights and responsibilities when you use our Services. By visiting, browsing, purchasing from, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy at /policies/privacy-policy. If you do not agree, you should not use our Services.

## SECTION 2 - PRODUCTS
We sell physical K-pop albums, photo cards, and related collectible merchandise. Certain products may be limited, sealed, random, first-press, pre-order, or condition-sensitive.
We make reasonable efforts to display product colors, packaging, and details as accurately as possible, but actual appearance may vary based on screen settings, manufacturing changes, or packaging differences.
Unless explicitly stated in a product listing, we do not guarantee specific random inclusions, inserts, benefits, or versions.
We reserve the right to modify, discontinue, or limit the quantities of any product at any time.
## SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. We reserve the right to accept, decline, limit, or cancel any order at our discretion, including for suspected fraud, pricing errors, availability issues, or policy violations.
Your order is not accepted until payment is authorized and we send an order confirmation or otherwise begin processing your order.
If we need to cancel or change an order, we may contact you using the email address, billing address, or phone number provided at checkout.
## SECTION 4 - PRICES AND BILLING
Prices are shown in U.S. dollars unless otherwise stated and are subject to change without notice.
Posted prices do not include shipping charges, customs duties, import taxes, or similar fees unless explicitly stated. You are responsible for all applicable taxes, duties, and fees associated with your order.
You agree to provide current, complete, and accurate billing and payment information and to promptly update it if it changes.
## SECTION 5 - SHIPPING AND DELIVERY
We currently ship to addresses in the United States and Canada only.
Processing times and delivery estimates are provided for convenience only and are not guaranteed. Carrier delays, customs processing, weather, holidays, release schedules, and other events outside our control may affect delivery times.
For orders shipped to Canada, you are responsible for any customs duties, import taxes, GST/HST, or other destination-country charges.
To the fullest extent permitted by law, risk of loss passes to you when the order is delivered to the carrier.
## SECTION 6 - PRE-ORDERS
Some items may be sold on a pre-order basis. Pre-order release dates, manufacturer schedules, and shipping timelines are estimates only and may change.
If an order contains both pre-order and in-stock items, we may hold the order until all items are available unless otherwise stated.
## SECTION 7 - RETURNS AND REFUNDS
All returns, refunds, cancellations, and exchanges are governed by our Refund Policy at /policies/refund-policy.
By placing an order, you acknowledge that collectible items, opened items, photo cards, random inclusions, pre-order benefits, lucky draw items, and final sale items may be non-returnable except as required by law or if they arrive damaged, defective, or incorrect.
## SECTION 8 - INTELLECTUAL PROPERTY
All content on our Services, including text, graphics, logos, images, videos, product descriptions, and overall site design, is owned by MooMoo K-pop, its licensors, or the applicable rights holders and is protected by intellectual property laws.
You may use our Services only for personal, non-commercial purposes. You may not copy, reproduce, republish, scrape, distribute, modify, or exploit any part of the Services without our prior written permission.
All third-party names, trademarks, artist names, logos, and product marks remain the property of their respective owners.

MooMoo K-pop is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with MooMoo K-pop. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and MooMoo K-pop, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with MooMoo K-pop.

TO THE FULLEST EXTENT PERMITTED BY LAW, MOOMOO K-POP, ITS OWNERS, AFFILIATES, SERVICE PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR SAVINGS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APPLICABLE ORDER.
## SECTION 20 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless MooMoo K-pop, Shopify, and our affiliates, partners, officers, directors, employees, contractors, and service providers from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

You agree to the exclusive jurisdiction and venue of the state and federal courts located in Washington.
